Federal Court Orders Release of Kilmar Abrego Garcia from Immigration Detention

Courtroom scene

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling charges, he was detained in immigration detention.

In her order, the judge pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal challenge involve disputed claims. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

Conditions of Release

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.

This ruling represents a significant turn in a complicated legal battle involving claims of wrongful detention and contested criminal associations.
